images-4-1Three women suffered injuries in a Saturday night ATV accident that took place in Monson, Massachusetts.  The women were riding the ATV along East Hill Road when the vehicle flipped over at a residential property in the area.  Monson Police were dispatched the 69 East Hill Road to investigate the crash.

One woman was transported to Bay State Hospital with injuries which were not classified as life-threatening.  The other two women were treated on scene but not taken to the hospital.  The women are only identified at this time as being in their mid to late twenties.  Monson Police are still looking into the crash and have not released an official reason for its occurrence at this time.  There is no further information given by police.

download-3-1In any personal injury case, the injured victim must prove that the other person was negligent in some way. Negligence refers to the failure to exercise reasonable car for the safety of others.  In some personal injury cases, negligence is disputed by the defendant or the insurance company.  So what happens then?

In Massachusetts, we have a law known as comparative negligence.  Under comparative negligence, if the victim was partially responsible for their injuries then their settlement value is reduced by the amount they are determined to be negligent.  The following is an example:

Suppose a pedestrian is walking at a crosswalk when he steps out into the roadway and is struck by a speeding vehicle.  If the pedestrian had looked both ways, he could have seen the vehicle coming in his direction.  However, he may not have had time to react because of the vehicle speed.  The pedestrian’s case is worth $100,000.00.

Alleged Drunk Driver Arrested in Three-Car Crash that Killed a 63-Year-OldOUI has become a serious problem in recent years across our state.  A 2012 study conducted by the Behavioral Risk Factor Surveillance System revealed that there 1,370 people killed in Massachusetts OUI crashes in a 9 year period from 2003 through 2012.  Of course, during that time the number of non-fatal OUI crashes experienced in the state would have been much greater.

OUI crashes tend to involve more serious and catastrophic injuries than other types of crashes.  One reason for this is that these accidents usually happen due to a complete loss of vehicle control by the impaired driver.  Whether because of drugs or alcohol, impairment means that the driver’s mental and physical capability are slowed considerably which also reduces critical factors such as reaction time, ability to perceive objects in the roadway and the ability to make judgments on matters such as depth perception and proper distance between vehicles.  When a driver loses control of these faculties, they lose control of a 2,000 pound piece of metal that can quickly become a deadly weapon.

In Massachusetts, it is illegal drive with a blood alcohol concentration of more than .08%.  It is also illegal to drive with any amount of a controlled substance such as a prescription medication or an illegal drug that impairs the ability to drive.  In drug and controlled substances cases, the opinion of the officer as to a driver’s impairment is critical.

Car Accident on Mass Pike EastA three car crash involving injuries happened Thursday evening in Wrentham, Massachusetts at approximately 10:00 pm.  The crash occurred on Route 495 at Exit 1-A.  At the time of the incident, three vehicles were traveling in close proximity to each other through a work zone.  The road was already narrowed due to the ongoing construction in the area.  One driver crashed into the other setting off a chain reaction involving the third driver.

Police responded to the scene.  As could be expected, traffic was a nightmare through the area, which had already experienced delays due to construction.  The injured were treated by medical technicians on scene.  No indication of whether the injuries are life-threatening at this time.   Police have not released an official cause of the collision or the names of drivers involved.

Boston Car Wrecks

Accident with Injury on Exit 1 on Route 95Route 1 was a busy area for motorists early Wednesday morning and traffic was slowed due to reasons other than the normal morning commute.  Drivers using Route 1 experienced delays due to multiple traffic accidents before 7:00 am.  One such accident occurred at the off-ramp to Route 1 when two cars traveling in the same direction collided with one another just prior to exiting the highway.   There is no word on which exit is affected by the crash at this time.

There are injuries reported in this collision.  A combination of police and medical personnel are at the scene helping with the clean up effort.  While personnel remain on scene, traffic is moving very slowly around the crash area as motorists highway access is limited at this time.  The crash should be cleared shortly allowing traffic flow to pick back up again prior to 7:00.  Authorities have not provided any further details on the nature of injuries suffered in this crash or the identity of the individuals or vehicles involved.

The Beverly police logs released today reveal that an accident occurred yesterday, on April 20.Hit-and-Run Accident Under Investigation in Beverly

Police reported to 8 Bow Street at about 1:30 p.m.

While there, they discovered a hit-and-run accident scene with damage.

A witness spoke to authorities, however no further details have been released publicly.

An inquiry continued into the two-car head-on crash in Wilmington, Massachusetts, which caused injuries to both motorists.Head-On Collision in Wilmington Under Investigation

Reports from law enforcement indicate that the accident happened at Hopkins Street at approximately 6:30 p.m. on Friday.

There were no other occupants in the vehicles.

One driver was a man who suffered serious injuries, and the other driver was a woman whose injuries were not as severe. Both were transported to the hospital.

The cause behind the incident is unknown at this time.

A single lane was blocked off to traffic on the Northbound Interstate 95 today due to a tractor-trailer accident. The vehicle tried to exit the highway Massachusetts I-95 crash injuriesinto the breakdown lane, but collided into the shoulder and flipped onto its right side. The driver tried to turn off the highway believing there was a problem with the items on the trailer.

The accident happened at approximately 7 a.m. around the Western Avenue and Civic Center Drive off-ramps. The lane was opened later in the day. However, the remnants of the crash were still being hauled away while the lanes were re-opened.

The driver of the tractor-trailer was identified as Massachusetts resident Joshua Linfield. He sustained injuries to the side of his body and was transported to the hospital from the scene.
