That’s according to a ruling in a recent case out of Washington state, where justices sided with plaintiff that medical device manufacturers have a duty to warn hospitals as well as physicians because doctors aren’t the ones actually buying the devices.

Although the ruling doesn’t have a direct impact on case law here in Massachusetts, it’s important to highlight because state high courts will often take cues from their sister courts when weighing important similar issues, especially those of first impression. Gaining a better understanding of pre-term infant brain injury can help reduce future incidents and improve outcomes for preemies. That’s why researchers at Boston Children’s Hospital, Harvard Medical School and NFANT Labs (an Atlanta-based company) are teaming up. The trio announced they would be collaborating to delve into the question of how neonatal sucking patterns could be an indication of brain development. If abnormal feeding patterns are proven to be an early indicator of an underlying brain injury, then doctors, nurses and other caregivers could take note – and quicker action to address it, ultimately improving outcomes.premature baby

Detecting a newborn brain injury early on is difficult. The current brain injury technology we have developed isn’t sensitive enough to pick up potential issues for babies that young. Even equipment that could work tends to be far too expensive for practical use on a regular basis. Prior research has established some type of connection between the way a baby sucks early on and later neurodevelopmental outcomes. A better understanding of this could help doctors detect brain abnormalities faster, which can mean initiating a number of early interventions.

Every year, some 500,000 infants in the U.S. are born premature. Of those, 60,000 babies are born weighing less than 3.3 pounds. Unlike in decades past, most of these babies will survive. However, preventing brain damage in these infants is often a challenge. So while these children are living, the rates of developmental disabilities and cerebral palsy stemming from brain injury are on the rise. Continue reading

In a recent opinion from the California Court of Appeal, student was injured during a high school football game.  During the game, he suffered a severe impact and began complaining that he was in serious pain.

footballAt that point, his coach shined a flashlight in his eyes, and it made him wince in pain.  At every football game, there is an ambulance crew on standby at the event. The coached alerted paramedics, and they came over and examined the injured student. They also saw he was unsteady while walking.  It took the crew minutes to get to him. Continue reading

In a case from the Washington State Supreme Court, plaintiff went to his doctor on September 1, 2011 because he had a painful lesion located on the bottom of his foot.  The doctor with which he made an appointment was his primary care provider (PCP).doctor

Once his PCP saw the wound on his foot, which was the result of stepping on a sharp object, he referred the plaintiff to a podiatrist. The podiatrist saw the plaintiff that same day and diagnosed him with what he called a pyogenic granuloma.  This is a benign (non cancerous) lesion.  The podiatrist said he could either remove it with surgery or treat it with cryotherapy using liquid nitrogen, as they often do when trying to remove warts from patients. Omarosa Manigualt, of “Celebrity Apprentice” fame, known generally by her first name, Omarosa, injured her foot or ankle while at the White House, according to TMZ.  Omarosa was at the White House as President Donald J. Trump appointed her as the director of communications for his office of public liaison.  This basically means she was named an adviser to Mr. Trump.

iceWhile the extent of her injury is unknown, as it could be either a fracture or a strain of some kind, it has been reported that she injured her leg at the White House and was then taken to Walter Reed National Military Medical Center in Bethesda, Maryland on the campus of what was formally known as the Bethesda Naval Hospital before Base Realignment and Closure (BRAC). It is hard to truly understand just how difficult it can be for a victim and his or her family following an accident or illness that results in a traumatic brain injury.  The victim may have trouble with gross and fine motor skills, struggle with memory loss, battle the inability to form new memories, and could suffer from one or more of the various types of dementia.

According to a recent report from Fox News, a man driving his pickup truck on Interstate 80 and was towing a large BBQ trailer when he crashed.  Authorities alleged that the barbeque trailer managed to become disconnected from the black pickup truck and resulted in a major car accident involving four other vehicles.

BBQWitnesses have said that when the trailer became unhooked, a woman driving a car directly behind it attempted to swerve out of the way to avoid slamming into the trailer.  Unfortunately, the three motorcycle riders that were directly following her vehicle did not have time to react and they all crashed into barbeque trailer at a high rate of speed, as this was a major interstate. According to recent news article from The Dispatch, the operator of a rented pontoon boat and the owner of the rental company have both been charged with criminal negligence in connection with a tragic accident that resulted in the death of a nine-year-old boy in Maryland.

boat-near-a-lake-and-lake-3-1480466-300x225Authorities report the defendant operator rented the boat in Ocean City from a boat rental company and was operating the pontoon boat with passengers seated on the bow.  Under the relevant state statute, it is illegal to operate a boat with passengers seated on the bow of the boat.  At some point during the ride, the young child fell off the bow of the boat, and the boat rode over top of him until the propeller from the boat’s outboard engine hit the boy, who was killed in the accident. Animal attacks happen a lot more often than people realize in cities such as Boston and across the nation.  In most cases, we are talking about cases that involve dogs and other common household pets, though some instances do involve exotic animals people choose to keeps pets, such as chimpanzees.dog bite

While many people have dogs as pets, and the vast majority of them are friendly, when a dog attacks a child, it can be the scariest thing imaginable for everyone involved.  In some cases, these dog attacks can result in serious injury or even death.  According to a recent news article from the Atlanta Journal and Constitution, one man’s dogs allegedly killed a young boy and seriously injured another young girl on their way to school.  He has been arrested and charged with two counts of reckless conduct, which are both misdemeanors, but prosecutors indicated they may be filing additional charges. In 2017, doctors and scientists know a lot more about traumatic brain injury (TBI) and other head injuries than they have every known before.  One major reason is that many of brave servicemen and women suffered traumatic brain injuries as part as of their efforts in fighting the global war on terror, as did many civilian contractors and third party nationals who were part of the effort.  Additionally, professional sports organizations, particularly the National Football League (NFL), have been paying special attention to TBI prevention.

pillsHowever, while we definitely have a much broader base of knowledge of about traumatic brain injuries, there is defiantly a lot more to learn about how the human brain works and what is the best way to treat a traumatic brain injury. According to a recent news article from Tech Times, researchers are hard at work to develop medications to treat a TBI.  The reason for this is because, while there are surgical options, they are very invasive and many have left the patients with lasting brain damage.
