injury-attorney-300x199Beverly, MA (July 10, 2018) –  A driver in Beverly, Massachusetts was injured in a motor vehicle crash on Monday morning. The crash occurred at 10:55 am when Beverly police were called to Tozer Road in reference to an accident with injuries.  Officers say that two vehicles collided with one another for unknown reasons.

Police discovered that one driver was injured in the crash and requested that an ambulance also respond to the crash.  The injured victim accepted medical treatment.  It is not known at this time whether the victim was also transported to the hospital for additional attention.  This accident remains under investigation with no cause immediately given by Salem police.  The drivers have not been identified and no criminal charges have been filed as of yet. No additional details are available at this time.

The crash occurred at 7:35 pm  on Washington Street, near the intersection with Mill Street.  Police say two vehicles collided with one another for unknown reasons.  The force of the collision caused the airbags in one of the vehicles to be deployed.

Police discovered that one driver was injured in the crash and requested that an ambulance also respond to the crash.  The injured victim accepted medical treatment.  It is not known at this time whether the victim was also transported to the hospital for additional attention.  This accident remains under investigation with no cause immediately given by Salem police.

No additional details are available as of Wednesday morning.

Brockton two car utility pole crashBoston, MA (June 28, 2018) – The Boston Police Department and rescue workers responded to an accident with injuries that took place in the city on Thursday evening.  The accident happened just before 7:00 pm when two cars collided in the 1100 block of Massachusetts Avenue.  Officer Fred Ferrara of the BPD was among the group of first responders to come to the crash location.  Officer Ferrara secured the scene while he worked to investigate the cause of the crash.

During the course of the investigation, it was discovered that at least one person suffered injuries requiring medical treatment.  Treatment was given on scene and the injuries are not life-threatening.  Police are still investigating the crash and have given no further information on the cause or identities of those involved.  There were some traffic delays while police worked to clear away the wreckage and re-open the road for traffic.

images-1-8Boston, MA (June 27, 2018) – Boston police responded to numerous injury accidents across the city on Tuesday as they seemingly left one accident scene and went straight to the next.  One such accident occurred on Quincy Street around 11:40 pm.  After the call came in to police, Officer Kelvin Ervin was dispatched to the scene of the collision.  Officer Ervin secured the area and began his investigation.

One person was injured in this accident and accepted medical treatment.  It is not known at this time whether the injuries sustained are considered to be serious or life-threatening.  This portion of Quincy Street was blocked while Officer Ervin investigated but was quickly cleared and re-opened to passing motorists.   There is no immediate update on the injured victim or the cause of the crash.  The accident remains under further investigation by the Boston Police Department. No word if charges are expected.

Accident on Route 146An accident with injuries was reported to police in Worcester, Massachusetts early Sunday morning.  The call came in to police headquarters just before 5:00 am.  Dispatchers were alerted at that time to an accident int he 100 block of Madison Street in the center of town, just off of Main Street.

Police quickly rushed to the scene of the accident as the caller referenced potential injuries associated with the accident.  Unfortunately, as they arrived on scene officers noted that the accident did involve injuries and quickly began the process of giving medical aid to the injured victim.  The good news is that the injuries sustained do not appear to be serious or life-threatening.

Worcester police are investigating the accident and its cause.  In the meantime, no further information has been released about the accident, including how it might have occurred or the names of those involved.

In Carter v. Reese, a truck driver was pulling this semi tractor-trailer into a loading dock at a contractor’s location.  He was supposed to drop off his empty trailer and pick up a new trailer.  He had attached the new trailer to his truck and was then trying to jump onto the loading dock so he could close the door on the trailer.  He could not do this until he pulled the truck way from the loading dock, as the door was open and the trailer was flush to the distribution center.

wheelchair5When he was trying to get on the loading dock to close the trailer door, he slipped and his leg fell between the trailer and the loading dock.  He was not in any pain, according to his testimony, but he was trapped between the truck and the loading dock, and he began to bang on the trailer and yell for help.  It took about ten minutes for someone to hear him. When someone is going to subdivide a parcel of real property, often before it can be sold as a build-able lot, the land owner will have to get a survey performed. While surveying has changed a great deal over the past 10 years as we moved from using chains similar to how a First Down in football is marked to sophisticated laser devices, surveying still relies heavily on the use of landmarks.

A landmark can be a natural thing such as large tree, or it can be an item placed in the ground by the surveyor.  The purpose of the survey is to mark off where one property ends and the adjacent one begins and then create a map or survey of that land to record in the records office. This way, there is no question as to where the property line is situated.  One of the common methods for marking these lines is for a surveyor to place a wooden stake in the ground and then put a safety flag on it to make it visible. After the perimeter has been marked, the surveyor will then replace the stake with a piece of metal rebar known as an iron and sink it into the ground so it can be found on a metal detector.  Continue reading

The suit was rented just for the rally as a way to mock the other team’s mascot, an eagle. But he didn’t want to go through with it anymore and pleaded with the athletic director to let him off the hook. Instead, she threatened him with the $75 cost of the rental if he didn’t keep it on and head to the pep rally as intended, where he was slated to engage in a “mock fight” with the football team. He acquiesced. It didn’t go well.

When it was all over, he suffered a traumatic brain injury that he will likely grapple with the rest of his life. Now, the school district has agreed to pay $10.5 million to settle the case after jurors found the school district 100 percent liable for the former student’s injuries. The settlement offer was extended just days after the verdict was reached, but in advance of the damages portion of the trial.  Continue reading

There have been cases in which courts have handed down eye-popping punitive damage awards, but that is usually only with the most serious of cases that involve catastrophic injury and death. The Massachusetts Legislature understands that there is unequal bargaining power between an individual claimant and, say, an international insurance company or a huge corporation. That’s why they have found that in some cases, monetary sanctions are the only to way to sway unlawful and unethical behavior.

Most of the time, these verdicts are affirmed. However in some cases, punitive damages may be deemed constitutionally excessive because they violate due process. Since 1989, the U.S. Supreme Court has decided at least nine cases that involve the question of constitutional punitive damages limitations, with seven of those using the theory of due process violations.

The high court’s precedent on this issue holds that a punitive damage award has to be set aside if the state court:

  • Finds the award grossly excessive;
  • Fails to provide defendant with a reasonable procedure to protect form grossly excessive awards.
