Hyannis, MA – Pedestrian Injured in Early Morning Crash

Hyannis, MA (July 7, 2018) – A pedestrian was struck by an alleged impaired driver early Saturday morning in Hyannis, Massachusetts. The collision took place around 1:00 am at the intersection of Main Street and Pine Avenue. The pedestrian was walking through the intersection when they were struck by the vehicle.

An ambulance arrived on scene and transported the pedestrian to a nearby hospital with injuries that were not believed to be life-threatening. The driver was investigated by Barnstable police following the crash. After administration of field sobriety tests, it was determined that the driver was impaired. She was arrested and charged with OUI, speeding and operating to endanger. The crash remains under investigation.

Massachusetts Dog Bite Law

According to a Study by the American Veterinary Medical Association, more than half of all Massachusetts residents own a pet. Moreover, 1 in 4 Massachusetts households keep a dog as the family pet. A study conducted by the Massachusetts Department of Public Health’s Injury Surveillance Program reveals that there are an estimated 6,300 dog bite injuries reported in Massachusetts that require medical attention every year.

According to MGL c. 140, s. 155 dog bites are strict liability offenses in Massachusetts. Strict liability is a legal concept which means that someone is liable for an injury to another regardless of whether they were negligent or not. This basically means that if your dog bites another person and the other person is injured then you are responsible even if you exercised reasonable care to avoid the bite from occurring.

Massachuetts Insurance Coverage Limits

In nearly every personal injury case, the amount of available insurance coverage is one of the initial and most important questions that must be answered. Several issues may arise in the context of determining the availability of coverage for a particular accident.

Coverage Minimum Limits

In Massachusetts, a person is required to carry automobile insurance and it is illegal not to do so. Any insurance policy issued in our state has minimum coverage limits. In Massachusetts, every driver is required to carry coverage with at least $20,000.00 per injured person and $40,000.00 per accident. Additionally, you are required to have uninsured motorist protection in the same amounts.

Depositions in Personal Injury Cases

If you are involved in a Massachusetts personal injury accident you may eventually have to sit down for a deposition. This may not be a comforting thought for many accident victims, however, a deposition is a necessary part of the process in many personal injury claims filed across our state each year.

What is a Deposition?

A deposition is basically a question and answer session with the other side’s attorney. In your case, an attorney representing the person who caused your accident or the responsible insurance company will be the person asking the questions. A deposition is electronically recorded and all activity is transcribed by a certified court reporter who will prepare a written transcript of the session. A deposition may also be video recorded. The deposition typically takes place in an attorney’s office and may last an hour or two or much longer depending on the complexity of your case.

Head and Brain Injuries

Injuries to the head and brain are commonly seen in car accidents and are among the most serious injuries that can occur. Unlike a broken bone or a muscle sprain, these injuries do not typically have a clear course of recovery and can be extremely complicated to treat, even under expert medical care.

Causes and Symptoms of Head Injuries

A traumatic brain injury, otherwise known as a TBI, is a particularly severe head injury. The causes of these vary, but they may be the result of a fall, motor vehicle accident, or an attack. A TBI may be experienced in a car accident when a person’s head collides with the steering wheel or dash inside their vehicle during the impact of the crash. The most common symptom of a TBI is a headache experienced shortly after the trauma. Other symptoms include dizziness, blurred vision, nausea, light sensitivity and inability to focus. The symptoms of a TBI may not be readily apparent for several days. Symptoms can seem minimal at first and then become progressively worse over the course of days or weeks if left untreated.

Sandwich, MA – One Hurt in Rollover Crash

Sandwich, MA (July 7, 2018) – A rollover crash took place in Sandwich, Massachusetts Friday evening, leaving one person hospitalized. The accident happened around 11:30 pm on Route 6, between exits 2 and 3. A vehicle was traveling in the eastbound lane of the highway when, for unknown reasons, the driver lost control and crashed the car. The car rolled over before coming to rest.

Police and fire officials responded to the crash scene. The driver was able to get out of the vehicle on their own before police arrival. The driver sustained injuries in the rollover and was transported by ambulance to Cape Cod Hospital for further evaluation. The driver’s injuries are not believed to be life-threatening.

Massachusetts State Police are investigating this accident and have released no additional information as of Saturday morning.

Hatfield, MA – Trooper Injured While Swerving to Avoid Deer

Hatfield, MA (July 7, 2018) – A Massachusetts State Trooper suffered injuries after crashing his cruiser early this morning on Route 91 in Hatfield. The Trooper was responding to a call for a disabled motor vehicle at approximately 1:30 a.m. when a deer darted in front of his police vehicle. The Trooper swerved to avoid the deer, but struck a guardrail instead. His vehicle then went over the side of the guardrail before coming to rest.

After the crash, the Trooper’s car became engulfed in flames. A second Trooper was luckily in the area and was able to pull the Trooper out before the accident became catastrophic. Hatfield and Northampton Firefighters responded to extinguish the car fire and provided medical aid along with EMS.

The injured Trooper, whose name has not been released, was transported to Cooley Dickinson Hospital in Northampton and was later transferred to Bay State Medical Center for further treatment. He has since been released from the hospital as of Saturday morning.

Boston, MA – Firefighter Dies in Motorcycle Accident

Boston, MA (July 7, 2018) – The Boston Fire Department announced on Friday that one of its own has died in a motorcycle crash. The deceased firefighter has been identified as Justin D. Poitras. Poitras died when his motorcycle crashed into a car at the intersection of Clapp and Boston Streets in Dorcester. Poitras was 31 years old at the time of his death and had served as a Boston firefighter for a number of years. Prior to becoming a firefighter, he served his country in the US Marine Corps.

There is no word on what caused the crash at this time and the other driver has not been identified. Police in Boston are still investigating the crash as of Saturday morning.

Lowell, MA- Hit and Run Victim Identified

Lowell, MA (July 7, 2018) – A hit and run victim in Lowell who suffered serious injuries in a crash earlier this week has been identified. On Tuesday, a woman was riding a motorized scooter along Middlesex Street around 10:00 pm when she was struck by a dark colored Mercury Sable passing through the area. The Mercury Sable fled the scene immediately after the crash.

The injured victim is 46 year old Donna Bettencourt of Lowell. Bettencourt sustained very serious injuries including a broken pelvis and a nearly severed leg. Doctors are still considering amputation if her leg does not respond to additional treatment.

Police are still searching for the hit and run driver. On Friday, they released images of the suspect vehicle but have yet to make any arrests.

Boston, MA – Injuries in Accident That Occurred on Binney Street

Boston, MA (July 7, 2018) – Binney Street in Boston was the site of an injury accident on Wednesday afternoon. At 6:34 am, Boston Police report receiving a call regarding a crash with personal injury. Officers on duty were dispatched to the accident scene shortly after receiving the call. Upon arrival, they discovered that at least one person was injured as a result of the collision.

Upon discovering the injures, officers also requested medical assistance on scene. EMS responded to provide aid and treatment was given at the accident site by emergency workers. We do not believe at this time that the motorist’s injuries were life-threatening. Officers did not identify those involved in the crash. This accident remains under investigation with the Boston Police Department.
