download-1-4-300x168In nearly every personal injury case, the amount of available insurance coverage is one of the initial and most important questions that must be answered.   Several issues may arise in the context of determining the availability of coverage for a particular accident.

Coverage Minimum Limits

In Massachusetts, a person is required to carry automobile insurance and it is illegal not to do so.  Any insurance policy issued in our state has minimum coverage limits.  In Massachusetts, every driver is required to carry coverage with at least $20,000.00 per injured person and $40,000.00 per accident.  Additionally, you are required to have uninsured motorist protection in the same amounts.

In a no-fault model, a driver who is injured in an accident must first file a claim against their own insurance company for injuries sustained in the crash. In some instances, no-fault insurance prevents the other driver from being taken to court in a personal injury lawsuit.

There are particular circumstances, however, in which an injured accident victim may file a claim against the other driver’s insurance company, including:

  • The injured driver sustains at least $2,000 in reasonable medical expenses; or

https://www.bostonpersonalinjuryattorneyblog.com/files/2018/06/2000px-Injured.svg_-300x300.pngA hit and run took place in Worcester, Massachusetts on Saturday evening, June 16th.  The incident occurred in the 100 block of Belmont Street.  Worcester police officers were dispatched out to the scene when the call came in around 9:00 pm.  Upon arriving on scene, officers located a victim who had been injured in a crash with another vehicle.  The driver who caused the crash, however, fled the scene before authorities could arrive.  The injured victim received treatment from emergency medical personnel on scene.

Police have not provided a description of the vehicle that they are looking for in the hit and run accident nor have they released the identity of the injured victim or the extent of their injuries.  We certainly hope that they are able to locate the person responsible for this accident.
