While it is far from the most popular outdoor activity in the Commonwealth of Massachusetts, quite a lot of people do go hunting every season in this state. The activity is generally considered safe for participants, there are obviously firearms involved, and any negligence could result in serious injury or death.  According to a recent news article from The Recorder, a teen from Worcester was just critically injured in a hunting accident.

shot gunThe 19-year-old victim was on a hunting trip when he was trying to negotiate his way across a small brook.  As he was trying to cross the narrow waterway, he accidentally shot himself with his hunting rifle.  He was shot in the chest, but, fortunately, he was not alone, as his cousin had accompanied him on his day of hunting. In a recent case from the Supreme Court of California, the case was tried before a jury, and jurors returned what is known as a special verdict. A normal verdict form is simply one that asks if the defendant is liable or not, and if the defendant is liable, then the jury is expected to also decide the amount of damages (financial compensation) that should be awarded to the plaintiff.  If there is no finding of negligence, then there is obviously not a need to return an award of damages.

toolHowever, there can also be special verdict forms that ask jurors to separately decide on different elements of a tort ,such as negligence, because in some cases, additional elements must be established for certain penalties and monetary awards to be triggered.  In this case, the jury returned a special verdict that found defendant was negligent in treating defendant, but that their negligent treatment was not responsible for him becoming a quadriplegic.  Continue reading

While golf is not exactly the most dangerous sport, there are certainly ways a golfer could get hurt.  However, most accidents, other than being hit on the head by a golf ball, usually involve joint and muscle injuries such as a torn rotator cuff or an ankle injury, to name a couple.  What doesn’t happen often is a golfer being injured by a falling portable toilet. Yet this is what happened recently to one golfer, according to a report from Golf Digest.

According to a recent news article from The Boston Globe, the family of a woman who died in a nursing home in Middlesex County has filed a lawsuit against nursing home and its parent company.  The family has alleged staff members dropped the victim and during the fall, she broke both of her legs and started to bleed internally.  Two days after the accident, she was dead. This occurred in 2015.

According to a recent news article from ABC 7 News, a 31-year-old man was killed in a horrific and confusing accident in which he was pinned between a commuter rail train and the station.  The accident happened during the evening rush hour when the victim was on his way home from work.

xrayAuthorities have said the victim, who worked as a mechanic nearby the commuter rail station, was waiting for a train, and, as it was approaching the station, he managed to slip off the edge or the platform and get his waist pinned between the train car and the platform.   While his injuries ultimately proved fatal, he was conscious and talking to firefighters as they worked to free him from the train. Skiing and snowboarding are very popular in Massachusetts and throughout the greater New England area.  There will be many people hitting the slopes each weekend until there is no snow left on the ground.  While this can be a great deal of fun, it can also be dangerous.  In some cases, the ski area will be liable for any injuries or deaths that occur on the mountain.

skiingAccording to a recent news article from People, a 10-year-old girl was killed while she was in the middle of taking a ski lesson.  Her mother said that while her child was skiing in the lesson, she lost control and crashed into a tree on New Year’s Day.  This crash resulted in severe head injury that soon proved fatal. With the arrival of winter, emergency room staffers are anticipating an uptick in the annual increase in the number of injuries related to snow and ice.  In some cases, these are serious or even fatal car accidents. Snow and ice may also play an integral role in injuries that occur when people slip and fall on the ice, according to a recent news article from Fox News.

While it is a natural reaction to try to put your hand out when you are falling, so as to brace yourself, it is actually one of the worst things you can do.  When your outreached hand makes contact with the sidewalk with all of your body weight behind it, it is easy to break your wrist or hand.  This is why snowboarders and those on roller blades are supposed to wear plastic guards on their wrists to prevent a broken wrist when falling. When we talk about head injuries and concussions, we are often talking about what is known as a closed head wound.  As the name implies, this is a head injury that can result in a concussion or other traumatic brain injury (TBI) in which there is no laceration to the skin, and the patient is not externally bleeding. Internal bleeding is likely occurring, and that can result in serious damage.

Most people are familiar with the concept of a slip-and-fall negligence case.
