Man Shoots Drone Flying Over His Backyard

Drones have become big news lately. The concerns are not only large surveillance and attack drones the United States Air force and Central Intelligence Agency (CIA) uses in the War on Terror, such as the Predator Drone. There are also fears regarding the smaller, publicly-available drones anyone can purchase and operate for less than $1,500.

The drones sold for personal use are legal for anyone to use without any kind of license, but they cannot be used for commercial purposes. If they were used for commercial purposes, such as filming movies or package delivery, it would fall under the authority of United States Federal Aviation Administration (FAA), which does not permit the commercial use of drones. This is what Amazon is trying to change so they can deliver packages by drones. It is also a law that these drones can’t be operated in restricted airspace. Continue reading

Cherry Bomb Accident Results in Serious Personal Injury

In yet another fireworks accident involving personal injury in Boston, a boy was seriously injured in what has been described as a cherry bomb accident. According to a recent news article from 7 News Boston, a boy was playing on a basketball court in Boston, when he found what has been described as a cherry bomb.

Authorities say the boy found the firework and attempted to light it. When he lit the firework, it exploded while he was still near it. The boy’s father was in his nearby home when he heard and felt the massive explosion. He immediately ran out to see what had happened and saw his 9-year-old son running toward him. He told authorities that, when he saw his son, he immediately noticed he was covered in blood and his eyelashes and eyebrows had been entirely burned off. Continue reading

Boston Chinatown “Shoving Encounter” Ends in Death

According to a recent article in the Boston Globe, a woman who lived in Chinatown was walking near her home on a Wednesday morning when another woman allegedly bumped into her. This woman, prosecutors say, has a criminal record consisting of charges for violent and erratic behavior.

The woman with whom victim made contact allegedly said she was responded to victim bumping into her by shoving her to ground. When victim hit the ground, her head slammed against the pavement. Prosecutors say alleged assailant kept moving but told prosecutors she heard people asking if victim was OK. First responders treated victim following the accident, and they took her to Tufts Medical Center, which is a level-one trauma center located in the Chinatown neighborhood of Boston. Doctors diagnosed her with a fractured skull and a brain hemorrhage. They took her into emergency surgery to control the bleeding in her brain, but her injuries were too substantial, and she soon died. Continue reading

Two Injured – Boy Loses Hand – Boston Fireworks Accident

Fireworks are a lot of fun to watch, but it is best to leave the actual process of shooting off the fireworks to trained professionals with proper permits and fire department personnel standing by in the case of an accident.

In fact, fireworks are illegal in the Commonwealth of Massachusetts, unless being handled by a licensed pyrotechnician with proper permits for the city and Bureau of Alcohol, Tobacco, and Firearms (ATF). Continue reading

Teacher Accused of Beating Children at Daycare Center

Daycare accidents caused by negligence of a daycare facility owner or the intentional tortious conduct of any employee can lead to a level of pain and suffering to victims and their families that is rarely seen in other types of cases. The reason for this is because there are few things more scary for parents of young children than leaving them in another person’s care for the first time. There is so much trust conferred to the daycare provider and his or her staff. When something bad happens, the violation feels unbearable.

According to a recent news article form WGAL, a woman daycare employee was recently accused of choking children in her care and beating them with objects such as spoons. Authorities say daycare worker would choke and beat the kids with wooden spoons when they would cry, and this was here method of getting them to be quiet when they would not listen to her commands. Some of the children in her care allegedly subject to this abuse were as young as three years old. Continue reading

Woman Sues Miami Marlins After Alleged Shark Attack Involving Mascot

We have been hearing a lot on the news these days about a increase in the number of shark attacks at beaches along the east coast of the United States. While some say they are not going to change their summer plans to the hit the Cape and other beaches, many are reacting to fears of increased shark attacks. However, according to a recent news article from Sporting News, a woman is suing the Miami Marlins Baseball Club for injuries she sustained in what is being called a “fake shark attack.”

According to her complaint, she attended a game at Marlins’ Park in 2013. As the team does at every home game, the “Great Sea Race” was held, in which mascots wearing foam and rubber costumes depicting various sea creatures run around the warning track in a foot race, and sometimes they engage in various other stunts or antics to amuse the crowd. Sarkisian v. Concept Restaurants, Inc.: Slip and Fall Accidents in Massachusetts

In Sarkisian v. Concept Restaurants, Inc., an appeal from the Supreme Judicial Court of Massachusetts (SJC), plaintiff slipped and fell at a nightclub in Boston owned and operated by defendant.

According to court records, the nightclub was licensed to hold 574 occupants at a time and contained a wooden dance floor, which was approximately 50 feet in length. There were two bars at which employees served alcoholic and nonalcoholic drinks, and these bars were both located on the dance floor itself. One of the bars was 50 feet in length and the other was 15 feet long. Customers were allowed to take their drinks served in plastic cups on the dance floor or drink them in any other part of the nightclub including the lounge area that was accessible by a flight of stairs.

Plaintiff and her friends entered the nightclub on an evening when the club was staffed by eight security guards, three bar backs and a manager, in addition to the DJ playing music and the bartenders. All personnel were responsible for making sure the dance floor was cleared of debris and safe for walking and dancing. Continue reading

Area Evacuated – 5,000 Residents Displaced after Toxic Train Crash

For quite some time, the fatal derailment accident involving an Amtrak passenger train was making headline news across the county. There were a variety of theories about the speed of the train and whether someone was shooting at trains in the Philadelphia area, and a variety of other theories.

Whenever a passenger train is involved in a accident, it makes sense that it captures the public attention. However, passenger rail service only accounts for a very small portion of the total rail traffic in the United States. Most of the rail traffic in the United States is for Freight Trains, which carry everything from coal to cars across the country. Some of the freight trains are filled with hazardous chemicals and fuels, and an accident involving a freight train can result in serious personal injury not only to those operating the trains, but also to the entire community around the crash site.

According to a news report from the Tennessean, the recent derailment involving a CSX freight train carrying toxic liquid chemicals caused serious environmental concerns and a town of around 5,000 residents was evacuated following the train crash. All of the residents asked to leave their homes and business were located within a mile and a half of the crash site. Emergency personnel went through the neighborhoods knocking on individual doors telling them they should leave immediately. Continue reading

Customer Sues Big Box Retailer for Slip-and-Fall Injury

According to a recent article from the WV Record, an injured customer is suing a major big box retailer for an alleged slip-and-fall accident resulting in personal injury.

This female plaintiff has alleged multiple negligence claims against defendant as being responsible for her slip-and-fall injury, which occurred in May of 2013 during a shopping trip to the store. In her complaint, plaintiff asserts she was in the pedestrian walkway of the store when the accident occurred. She further alleges defendant had breached its duty of care owed to her by allowing standing water to remain in the area designated for pedestrian traffic. Continue reading

Alan Dershowitz Sues Boston Arena for Slip-and-Fall Injury

Boston Attorney and Harvard Law professor Alan Dershowitz, best known for his role on the O.J. Simpson defense team during the world-famous murder trial, is making headlines once again. This time, according to a recent news article from The Boston Globe, Dershowitz is suing the TD Boston Garden arena where the Boston Bruins and Boston Celtics play for alleged negligence involving a slip and fall accident.

Through his complaint, Dershowitz alleges he was at the arena while attending a Boston Celtics game nearly three years ago. While at the arena, he went to use one of the bathrooms in the facility and slipped on an allegedly wet floor near the sinks and fell to the ground, injuring himself. He is blaming the hazardous condition of the floors on the arena operator’s failure to adequately supply the bathroom with paper towels. Continue reading
