A lot of people who live in Boston and the surrounding area like to drive down to the Cape this time of year. If you take a ferry or drive all the way to the end of Cape Cod, you can spend some time in Provincetown, which can be a lot of fun.

Every summer, families across the country head out to amusement parks and water parks. Some families go to local amusement parks, such as Six Flags in Agawam, Massachusetts and other families will travel much further away to go to larger attractions like Disney in Orlando, Florida.

Over the past month we have seen a number of examples of people seriously injuring themselves and others with fireworks and firearms in what are essentially accidents. With respect to the fireworks accidents, it makes sense to see an increase around this time of year due to the Fourth of July holiday and other summer holidays in which fireworks are used.

Some activities, while they can be quite fun, come with a certain level of danger. For example, if you go skydiving, you are assuming the risk that you may be injured. If there is an accident that is nobody’s fault, you could break bones or even be killed. You or your surviving family members would probably not have a valid lawsuit to file because this a risk you had assumed when deciding to go skydiving, and if a judge determines there is assumption of risk, it is unlikely you will prevail on a negligence theory. Drones have become big news lately. The concerns are not only large surveillance and attack drones the United States Air force and Central Intelligence Agency (CIA) uses in the War on Terror, such as the Predator Drone. There are also fears regarding the smaller, publicly-available drones anyone can purchase and operate for less than $1,500.

If they were used for commercial purposes, such as filming movies or package delivery, it would fall under the authority of United States Federal Aviation Administration (FAA), which does not permit the commercial use of drones. This is what Amazon is trying to change so they can deliver packages by drones. It is also a law that these drones can’t be operated in restricted airspace. Continue reading

In yet another fireworks accident involving personal injury in Boston, a boy was seriously injured in what has been described as a cherry bomb accident. According to a recent news article from 7 News Boston, a boy was playing on a basketball court in Boston, when he found what has been described as a cherry bomb.

warning-icon-glossy-6-1023556-mAuthorities say the boy found the firework and attempted to light it. When he lit the firework, it exploded while he was still near it. The boy’s father was in his nearby home when he heard and felt the massive explosion. He immediately ran out to see what had happened and saw his 9-year-old son running toward him. He told authorities that, when he saw his son, he immediately noticed he was covered in blood and his eyelashes and eyebrows had been entirely burned off. Continue reading

According to a recent article in the Boston Globe, a woman who lived in Chinatown was walking near her home on a Wednesday morning when another woman allegedly bumped into her. This woman, prosecutors say, has a criminal record consisting of charges for violent and erratic behavior.

1100586_safe_walkThe woman with whom victim made contact allegedly said she was responded to victim bumping into her by shoving her to ground. When victim hit the ground, her head slammed against the pavement. Prosecutors say alleged assailant kept moving but told prosecutors she heard people asking if victim was OK. First responders treated victim following the accident, and they took her to Tufts Medical Center, which is a level-one trauma center located in the Chinatown neighborhood of Boston. Doctors diagnosed her with a fractured skull and a brain hemorrhage. They took her into emergency surgery to control the bleeding in her brain, but her injuries were too substantial, and she soon died. Continue reading

Fireworks are a lot of fun to watch, but it is best to leave the actual process of shooting off the fireworks to trained professionals with proper permits and fire department personnel standing by in the case of an accident.

In fact, fireworks are illegal in the Commonwealth of Massachusetts, unless being handled by a licensed pyrotechnician with proper permits for the city and Bureau of Alcohol, Tobacco, and Firearms (ATF). Continue reading

Daycare accidents caused by negligence of a daycare facility owner or the intentional tortious conduct of any employee can lead to a level of pain and suffering to victims and their families that is rarely seen in other types of cases. The reason for this is because there are few things more scary for parents of young children than leaving them in another person’s care for the first time. There is so much trust conferred to the daycare provider and his or her staff. When something bad happens, the violation feels unbearable.

n5EjxDUAccording to a recent news article form WGAL, a woman daycare employee was recently accused of choking children in her care and beating them with objects such as spoons. Authorities say daycare worker would choke and beat the kids with wooden spoons when they would cry, and this was here method of getting them to be quiet when they would not listen to her commands. Some of the children in her care allegedly subject to this abuse were as young as three years old. Continue reading
