Fatal Car Accident Lawsuits

A car accident fatality is tragic for the surviving family members who are entitled to seek damages for the loss of their family member. This is known as a wrongful death lawsuit. The Massachusetts wrongful death lawsuit will seek monetary support that was lost due to the family member’s death. Even the loss of the love and attention of the family member will be calculated in a damages award. Out-of-pocket expenses for the fatality can also be recovered in a wrongful death lawsuit such as funeral arrangements, and any attempts at life saving medical treatment.

The individuals that can sue for compensation include the spouse, partner and children of the victim. There are circumstances when stepchildren, parents and unmarried partners, that hold themselves out as a spouse, can sue.

A wrongful death lawsuit requires a showing the other driver commit a negligent act that was the cause of the death. This is typically shown by establishing that the offending driver was driving at a high rate of speed, intoxicated, or distracted before the impact which caused the death.
