Fitchburg, MA – Woman Charged With OUI After Striking Girl

Fitchburg, MA (July 2, 2018) – A woman has been charged with OUI after striking a 5 year old girl Sunday night in Fitchburg, Massachusetts.  A large number of children were playing in an area on Redman Street when a 2000 Ford Explorer came through the area at a high rate of speed.  The Explorer struck the 5 year old girl, who was injured in the crash.  The girl was transported to UMass Hospital for her injuries.  The injuries are not life-threatening and it is believed at this time that the girl will make a full recovery from the crash.

The driver, identified as 55 year old Lori A. Bancroft of Pepperell is facing an OUI charge stemming from the crash.  Police say Bancroft was wearing two fentanyl patches at the time of the collision.  A third patch was found inside her vehicle.  Officers describe her as unsteady on her feet and drifting in and out of consciousness.  She was taken to jail and later released on a $500 cash bail.

This accident is an unfortunate reminder of the dangers associated with impaired driving.  These accidents involve more than just drinking.  Prescription medication and opiate abuse have become an epidemic in our country and we are seeing an increase in the number OUI incidents caused by drivers impaired on opiate-type substances, including fentanyl and heroin.  The results can be catastrophic and deadly.  Fortunately, the girl injured in this crash is expected to fully recover from her injuries.

If you have been injured in a Massachusetts OUI case you are entitled to recover for your injuries including: pain and suffering caused by the accident, medical bills, lost wages from time missed at work and potentially punitive damages.  Punitive damages are a special type of monetary compensation which are awarded in cases of extremely negligent or reckless behavior.  Driving under the influence can be an example of this type of behavior and may support a punitive damage award.  You need an experienced lawyer to assist with these issues.
